    Sreeanne is correct. We had one friend who died in 9-11 and his wife and kid got visa to stay back for few years until she finished her paperwork. Plan for 2-3 options for your family, and just dont depend on continuing GC.

    Patterns say AOS/EAD/AP application will be moved to TSC [if your I-140 is related to TSC] but USCIS retained the Receipt date @ NSC Received date. Not sure who assign RN and encash the check? TSC or NSC. Most probably TSC. :confused:

    I received the receipt number today from my attorney

    My application was received in Nebraska on 19th June, filed concurrently, with I 140 pending in Texas since 5/16
    My I 140 was approved on 27th July.

    My receipt numbers are as below, so it was moved from Nebraska to Texas

    I-485- SRC-07-230-xxxx
    I-765- SRC-07-230-xxxx
    I-131- SRC-07-230-xxxx

    The way i understand this, not all companies are bound by the EOE laws.
    Certain conditions have to be met to be considered an EOE.

    Not every employer is an equal opp employer, so those guys can hire whoever they want.
    Besides hiring folks on h1b, etc could add to costs for employers. So they choose not to employ such folks.

    All US Employers (that have 15 or more employees) must follow labor laws. EOE applies to all of them.

    However, this is for lawful authorized workers only. In other words, one can not force employer to file for H-1B or any other work visa. At the end of H-1B petition date, employer can not be asked to extend H-1B. That is employer's choice.

    But, once hired, H-1B employee can not be discriminated with other workers for equal opportunities in training, job promotions, and work conditions.

    Another reason was IV was relying on skil bill but when point system is used Skil bill does not fit into it. They threw it away. Also skil bill was asking exemptions for MS and STEM apart from increase in numbers(Congress never gave exemption from Cap except spouses of citizens). It might be better with just giving numbers so that only one provision was there. I think now IV is asking only numbers of green card and this campaign has better chance of success(atleast some increase in numbers). But if we focus multiple things(Involving in H1b issues and other smaller issues) at the same time then it may be tough to achieve.

    There is not such out of touch or education needed to be done. Congressmen are well aware of the plight of legal immigrants way before than immigrationvoice.org dreamed of existence. We fought hard in order to educate congressmen and often their staff played dumb, but again the truth is that they never cared about our plight.

    The reality is that this, as usual, is primarily driven by business needs. Major employers such as Bill Gates lobby mainly for H1B numbers increase. Employers are very much aware that H1B staff under pressure can put up and deliver the very long journey of 60-80h/week expected at Microsoft. Yes, Microsoft and many other major employers could easily find qualified US students with two years of experience, skills by the way comparable to what the vast majorities of H1B's offer, but Americans who do not need the H1B would give a finger to any employer who would expect that an American would work 80h/week for 55K/year.

    The illegal aliens are being backed by major employers of cheap labor, such as Wall Mart and many others. Illegals also can put extra long hours and therefore they yield more output for less investiment. That's is the reason that US employers seem to fight so consistently to keep them here.

    I estimate that immigrationvoice.org efforts do not count for 0.5% of the final result of this bill. As a matter of fact, chances are more we fight and protest, more people will be outrageous and scared and will call *their* congressmen even harder in order to push us out.

    For the naive and dreamers out there who are shaking their heads after reading the above and believe that employers cannot find qualified applicants, so just answer this:
    How many million dollars per year are the top management of Fortune 500 companies making? The US is not about drastic wages inequalities. This is about paying a fair salary, otherwise we have increasing salary inequality and this should be renamed then to Mexico, India or something like that.

    Why SKULL bill ? As a high level manager I have learned after years of experience that you need to use good sense of humor, satirize when confronted with insanities and very stressful situations.

    I appreciate your effort to make us smile and relieve stress but when you repeateldly

    You too must have realized it by now as people have started questioning why

    Let me ask you a question.

    When you renew EAD what will be the start date. For example:
    Lets say current EAD Expires 12/31/2007.
    I apply for renewal in July say 07/01/2007.

    When I get the new EAD would it start from 12/31/2007 to 12/31/2008 or sometime in July/August/September when it gets approved?

    Basically would the renewal date start from where the current one is expiring or from the dat it got approved?

    I have observed whichever is later
    Meaning your current EAD valid till 12-31-2007 and approval is before then starting date is 01-01-2008
    If approval date is after 12-31-2007 then starting date is approval date.

    I could not understand from sirinme the below -
    As long as you applied for renewal you should able to work - that is what i was told from my attorney
    "I did have trouble with AC21 once. I ended up having a gap between my 2nd and 3rd EADs (so did my wife too), as we tried to do too much 'optimization' of EADs. Well, we learned the hard way that 'optimization' effort is bad, as both of us had to stop working during the gap. It's not a very pleasant feeling having to explain our respective employers that we had such issue. We lost money too, as we couldn't be legally paid during the gap - in addition to the unnecessary stress. I wish USCIS issues EADs with longer validity period - something like 3 years (but I once heard Aman say that they couldn't do so due to a software glitch in their system!!). In any case, we are now filing for EAD renewals well in advance of the current one's expiry."

    Can an employer revoke the I-140 after 180 days of I-485 pending?

    Yes. However, AC-21 can save the I-485 for the beneficiary even if I-140 is revoked/canceled as long as the date of such request is dated after 180 calendar days of I-485 filing date.

    Hi,
    I got my EAD today...Even i received my EAD also...Mine is sent to NSC on july 2nd...I received EAD's from Texas Center...I think my application was transferred to Texas...I have approved I-140 from Texas...Are receipt numbers for EAD, 485, AP are in serial? I haven't received receipts yet...I filled G-28...my attorney did not receive my receipts...I don't know what is going on...

    AWESOME !!!! CANT WAIT TO GET OUR DAMN RECEIPTS!!!!!!!!!! GLAD TO SEE THE SECOND CASE OF TExas I140 with NSC I485 filing!!!!!!!!!!
