Re: A Great New Commission
Ladies and Gentlemen:
Our nation holds paramount equal treatment under the law. My principal question is, what federal laws may I break so that I am rewarded with amnesty to the tune of $18,000 per year?
That would bring me parity with the estimated costs to society of illegal aliens. These are in health, education and related social benefits. Oh, and the approximately 30 percent of our prison population which is comprised of some of these aliens. Seems some of the cost is borne by victims who are assaulted by aliens doing the crimes Americans just won�t do.
I�ll even give you a bargain. As a small business owner, my real and opportunity costs to comply with federal statutes and regulations are substantial. These are not taxes, they are non-deductible costs I incur to comply with federal law. My daughter�s chronic medical condition and my own heart condition also incur substantial expenses. Regarding our health, my family is uninsurable due to these conditions. We have never received assistance under any state or federal programs.
All of these costs come to something over $27,000 per year. So, when you give me my amnesty and my $18,000 per year, you will fall short of my expenses by approximately $9,000. Since you are wise in the ways of federal accounting, you can inform your constituents that you have in fact saved $9,000 per year, in addition to the moral claim of having granted me amnesty.
It will be appropriate to consider that in fairness my children should be due anchor amnesty. This from the fact that they still will be my dependents when you soon grant me amnesty. If you delay, well, my daughter will always be my dependent.
Considering possible delays, especially since fellow citizens will have their own tailored amnesty petitions, I understand if you need to charter a Federal Amnesty Commission. That is sure to renew respect for and compliance with the laws you draft. Any shortfall in compliance, up to say, twelve million offenses, you could graciously accept as appropriate civil disobedience. After all, that would assure you more press time as we enter this latest election cycle.
You are wise also in federal laws which may be broken with no consequence. I am too busy supporting my family, you, and the twelve million scofflaws and their employers to understand such matters, so I need your guidance. You know where I live, my drivers license number, my social security number, my bank and credit account numbers, as well as my email, internet service provider, taxpayer identification number, mortgage holder, business licenses and telephone numbers.
Please contact me soon. Given the rising medical and other costs, I need that $18,000 quickly and retroactive to the enactment date of S.1348. It�s only fair.

I have a electronic mail from them with the 140 receipt Notice (as PDF)
from USCIS.. I took the LIN number from there and Queries USCIS - they says USCIS received my App on May 15th and under processing....
I took a Print out of that 140 receipt Notice and will attach with 485 Application... My approval will not come before Jan-Feb 2008.
Just wanted to let you know, if your 140 is pending, you will have to submit the receipt notice and also the copy of labor cert showing the PD. Read page 4 below the NSC mailing address.

Been in the US since 1998, have an EB-2 PD of 2001, have played by the rules all along. Still no GC... And, the dates are going back to 2000 from the new year.. I've lost hopes...
I'm pretty close to getting clinical depression because of this game played by USCIS, Labor Dept, FBI and my own bad luck.
SKILL bill, OMNIBUS, etc. comes and goes. IV does seem to be doing things to lobby for the community, but let's face one reality. Like a news article said, no one in congress or senate wants to touch immigration even with a long pole until 2009.
The US has been very good to me (other than the GC part), more than my home country (India) which is why I'm still here.
Have invested too much of time in this country to just pack up and go. Just curious if any of you feel this way? How do you handle such depressing feelings?

My husband's coworker s from his first/second employers who came during same time are close to get citizenship. This is my first post.
My Employer's Inhouse Attorney ( one of big 4 ) says technically EB dependents ( all 1,2,3) must be classified under FAMILY quota. USCIS mis classifies them under EMPLOYMENT quota.
Is he technically correct ?
Since, Most of dependents will not be affected when they are classified under Family quota (as they have AP and EAD).
Can IV possibly consider for push for reclassification of Dependents under Family Quota ? This will reduce backlog.
Please don't take it out of context, I am not trying to hurt any EB dependents, I too have a spouse working part time using beneficiary EAD. This is more of an open question.
Will you join our hands in recapture ? Will you considering contributing to IV. I will be happy if you can activlly participate in our effort.

You being US citizen or president of USA does not mean much to us! I have requested you to show me "so called 30 day rule" on any of the official web site (For example USCIS). I have asked you this several times. Every time You just direct us to some lawyer's web site/university web site and expect us to believe them.

One of my friend got "Card Production Ordered" email. He is EB2-I, PD Jan 2006, RD- Sep 30 2007, NSC.
Mine is Dec 2005 and still waiting. So what is going on with NSC? Are they also doing the same thing that TSC is doing? latest cases first?

If someone ports from eb3 to eb2 they should get the priority date of the day they were eligible to file an eb2 and not be able to carry the date from eb3.
Porting makes sense in a family based visa where your petitioner can file for an application while he is still a green card holder and then becomes a citizen which upgrades the beneficiary's category as well.
On an employment visa you file for an eb3 when you are eligible for an eb3 job, you file for an eb2 when you are eligible for an eb2 job. Why would you be able to jump ahead in the eb2 line when you were clearly did not have an eb2 job ? Just because you filed an application at some point of time in eb3 and waited a decade to get a better job doesn't mean someone else has to pay for your (pick one - laziness, ineptitude, lack of skill or lack of knowledge).
Most of IV Core is made of eb3 applicants and therefore there has never been any push from the core on this matter. And as someone said .. You ARE eating my lunch..

Let us first complete July 10th mission flower campaign, where many people here including me has sent flowers for july 10th delivery.
Let us see its impact by July 11th and then try another round by sending flowers to local senators and congressmen with simple message of costs involved and lost money and oppurtunity by revised july bulletin.
Also, unless we make explicit mention of costs involved, i think impact wouldnot be felt.
Please plan the missions one after the other.

I filed 485/EAD/AP on May 31st and TSC received on June 1st. My checks haven't been cleared yet. TSC is said to be the slowest one. In a chinese forum, several people whose PD became current on June 1st got 485 approved recently. Their cases were all transferred to NSC recently.
BTW, how long will it take to get EAD? I sort of remember that it takes at most 3 months.

Even if we have five people agree to file this class action lets do it .....
Once we have this law suit filled I'm sure will have the visiblity and whole band wagon will behind us.
1, Let choose an attorney who understands our pain wants to fight for our cause. if its Rajiv Khanna so be it.
2, Whatever the inital attorney consultion let split the consultation fee between five of us.
3, Once we have a stream lined class action in place will gather more people.

I will have to check with my attorney. But, my I-140 approval came from TSC but my I-485 application was sent to NSC.

I received FP notices for myself and spouse on Saturday, Dec 22 for FP at the Charlotte office on Jan 11.
